NSPS Regulations

Now that Judge Collyer has decided that part of the labor relations component of the new pay for performance system at DHS is illegal and has placed an injunction on it the stage is set for the next act which will be very interesting to myself.
The NSPS regulations are likely to be very similar to the DHS. Mary Lacy, the PEO of NSPS, had previously stated that decisions concerning the DHS would not affect the NSPS schedule.
When the NSPS regulations are finally published I will not be very surprised to read them and discover that they still contain the provisions that Judge Collyer found to be illegal.
If I am correct I can only assume that the NSPS would be hoping that a different judge may view the reduction in employee appeal rights, and the policy of using implementing issuances to abrogate previous contractual agreements not to be an illegal act in the NSPS as Judge Collyer decided they were in the DHS.
