Congress has called for the Department of Labor to abandon a proposed rule change that could increase the danger of worker exposure to toxic substances, according to Carol Leonnig’s followup in the Washington Post. Leonnig yesterday broke the story about Labor seeking to introduce a new layer of bureaucracy into the regulation process (essentially blocking the Department itself from regulating toxins) and excluding OSHA and MSHA from the usual review process. Senator Edward Kennedy and Congressman George Miller said Labor had actually "violated the rule requiring federal agencies to alert the public twice a year" to proposed rule changes of this kind. But a Labor representative said it was premature to comment on the proposal since no one has formally seen it yet. Wonder how the editing’s going over there on Constitution Avenue. -NH
